Article Four – Usage Regulations: The consumer commits to using the store’s electronic platform in accordance with public morals and the applicable regulations in the Kingdom of Saudi Arabia. The consumer commits that when purchasing a service or product from this store, he will not use this service or product in a manner that violates public morals and the applicable regulations in the Kingdom of Saudi Arabia. Article Five - Accounts and Registration Obligations: Upon applying to join as a member in this store as a user, you are committed to disclose specific information and choose a username and a secret password to be used when accessing the store’s services. Article Six - Electronic Communications and Official Communication Channels: 1- The parties to this agreement agree that communication is via the email registered on the platform. 2- The consumer agrees that all agreements, announcements, data, and other communications electronically provided are equivalent to their written counterparts, and they are standalone evidence to meet legal and regulatory needs. 3- The consumer agrees that the store management may contact him and inform him of any provisions related to this agreement or dealing with him through sending general messages to all consumers or specific users of the store. Article Eight – Payment and Settlement Services for the Store: 1- The store provides through its partners a payment and settlement system, which can be fully online via the available payment options on the store or through any payment method provided by the store from time to time. 2- The store commits to setting the price of the service or product it offers in its store according to the recognized market value. 3- The store commits to providing invoices, receipts, and delivery notes for all amounts and profits generated in its store, and to give the consumer an invoice for purchasing a service or product. 4- The store commits to providing accounting specifications recognized in its electronic store, in accordance with the provisions of this agreement, and for the legal, economic, commercial, and regulatory interests involved. Article Nine – Intellectual Property: 1- The intellectual property rights of the store are fully owned by the store, whether owned before or after establishing this electronic platform. 2- The consumer respects the store’s intellectual property rights, including the store’s name itself, words, logos, and other symbols displayed on it, as each right associated with the store’s name is a full intellectual property right owned by the store. Article Ten - Store Responsibility: The store commits to conducting its business through this electronic platform in a systematic manner and in accordance with the applicable laws in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement. The store is not responsible for any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the consumer, or by a third party such as shipping companies. The (store name) and its affiliates, owners, and representatives shall ensure that the (product or service) is legitimate, lawful, and approved according to the laws and regulations of the Kingdom of Saudi Arabia and used for lawful purposes. Article Eleven - Access or Membership Restrictions: The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to the platform services at any time and without prior notice and for any reason, without specifying. Article Twelve - Applicable Law or System: This usage agreement is governed and drafted according to the laws, regulations, and legislations in force and valid in the Kingdom of Saudi Arabia, and is fully subject to the regulations of the authorities in the Kingdom of Saudi Arabia. Article Thirteen - General Provisions: If any material or clause in this usage agreement is canceled or becomes invalid, such matter does not cancel the validity of the remaining materials, clauses, and provisions of this agreement, which remain effective until further notice from the store management. This usage agreement — which may be amended from time to time as necessary — constitutes the usage agreement, the working mechanism, understanding, agreement, and contract between the store and the consumer, and both parties agree to consider the following: - The Arabic language is the applicable language when interpreting the provisions of this agreement or when translating it into another language. - All prices displayed for services or products of the store may be amended from time to time. - Promotional or marketing offers that the store may place are temporary offers, and the store has the right to modify or stop these promotional or marketing offers at any time. - The parties to this agreement commit to dealing with each other in a manner that does not violate Sharia rules, applicable regulations, and laws related to the nature of the dealings between the store and the consumer. - This usage agreement is only canceled by a decision issued by the store management.
